Redefining security perspectives under the weighting of rights due to COVID-19 pandemic

Resumen
Ante la pandemia por COVID-19 los países desplegaron todas sus capacidades humanas e institucionales para evitar que sus poblaciones resultaran gravemente afectadas. Ello llevó a evidenciar las posturas y estructuras prevalecientes al interior de cada Estado y a redefinir el camino que estaban dispuestos a adoptar para hacer valer su visión de gobierno y de nación, tanto al interior de sus territorios como hacia el exterior.
¿Cuál es el papel del Estado frente a sus obligaciones de derechos humanos en contextos inesperados y de urgencia?, ¿cuáles son los alcances para garantizar plenamente tales derechos? Este artículo busca resaltar que algunas medidas adoptadas por los países para proteger a sus ciudadanas y ciudadanos del coronavirus SARS-CoV-2 limitan el ejercicio pleno de derechos humanos.
Si bien de manera material se ha optado por el uso de las Tecnologías de la Información y Comunicación (TIC) que recolectan datos sin el permiso de las y los ciudadanos, y se dispone de éstos para identificar sus afinidades y sus espacios sociales, en la realidad estas estrategias provienen de las definiciones y prioridades que se tienen sobre qué implica la seguridad.
Así vemos que algunos contextos son más favorables que otros para la diseminación de narrativas que en la práctica buscan someter y restringir la garantía plena del ejercicio de los derechos fundamentales de las personas, ofreciéndolas como alternativas para responder a la urgencia que representa la atención a la crisis por la enfermedad de COVID-19.
Es por ello que se considera pertinente hacer un abordaje desde la doctrina de la interpretación conforme, con el fin de disipar dudas sobre las supuestas tensiones entre cuáles son los derechos fundamentales a proteger, cuáles se deben restringir y hasta dónde se deben de extender las facultades del Estado.
Abstract
Faced with the COVID-19 pandemic, countries deployed all their human and institutional capacities to prevent their populations from being seriously affected. This led to notice the prevailing positions and structures within each State and to redefine the path they were willing to adopt to enforce their vision of government and nation, both within their territories and abroad.
What is the role of the State in relation to their human rights obligations in unexpected and urgent contexts, and what are the scopes for fully guaranteeing them? This article attempts to highlight that some measures adopted by countries to protect their citizens from the coronavirus limit the full exercise of human rights.
Although, in a material way, some have opted for the use of information technologies, which collect data without permission from their citizens and use them to identify their affinities and social spaces, in reality, these strategies come from the definitions and priorities that are held about what security implies.
Thus, we see that some contexts are more favorable than others for the dissemination of narratives that seek, in practice, to bend the full guarantee of the exercise of fundamental rights of people, even when those have been offered as a response to the urgency of the COVID-19 crisis.
For this reason, it is considered pertinent to take an approach based on the doctrine of conforming interpretation, in order to dispel these doubts about the alleged tensions between which are the fundamental rights to be protected, which should be restricted, and how far the State's powers should be extended.
